Hopefully this will help us understand the load.

I called USCIS today morning, response was by end of this (oct)month they will complete all data entry for I-485. He told that last week they did lot of entries for July 2 and we should see the receipt number any time soon.

Yes, but I won't be surprised if the USCIS lawyers interpret the law to suit their convenience. And even worse, the judge buys it.

I am so sad and speechless after reading this. The next moment, I remembered that, my Metlife Insurance agent's husband had the same story. But miracle happened; he survived. So don't loose your hope. Sometimes hope is the best medicine.

To answer your question, though I am not aware of any laws for this type of situation, we can always try. I would try to get an appointment with either Zoe Lofgren or Nancy Pelosi. May be there are ways. If you need help, let us know we can accompany you.

Retrogressed all the way to 2000? Happened at the end of Q3 in the government calendar. Seem to me USCIS is laying the ground to assign all un-used visa number to indians in Q4. Just a guess....
Indians have older PDs than Chinese, so its a fair game if that happens.

I think culture vs quality of life is a different thing.
I am not saying that one place is better than the other...
There are many things for which I love living in the US...long list...
there are many things for which I love living in India...I think the list might not be as long as the US one....
2 of the main things I miss in the US.
1. Parents , Siblings and extended family....I do not know how much time anyone will have for me if I were to go back -:)
2. Culuture...mainly for the kids...here once the kids are 10 or 11 I think you cannot tell them anything much...they have thier own mind and will not listen to you....and might end up making wrong decisions...again not saying that this is 100% safe in India...but agian in India I think the kids listen to you till they are a little older....this helps as they might be a little more mature by then and hopefully will make more wise decisions...
Again, I am not saying life is easier or better in one place compared to the other...
If I were to go back to India (which is what we plan to do in 2 years from now) then it will be becuase of the 2 main reasons above...I really wish there was a work around for the 2 above and I would then stay back -:)
Both are great countries with plus and minus....

And yes in the 8 yrs I have been with my company I have got 3 promotions and am now a Manager. My companys immigration lawyer said thats ok. He just joked that when you get your green card just make sure you get tripple demotion to new role.
So when new kids on the block (<5 yrs in US) talk about GC process being screwed up, I say pick a number and wait in line. The closest example to this feeling is waiting to go to the restroom when you live in a slum and there is line of 100 ppl ahead of you to use the loo and you have loose motions :)
well you have a cooperative lawyer and a co operative employer...That is not always the case...Sometimes the employers are just using this excuse to keep folks working in the same position just because it suits employer's interests....

I would advise not to go for your landing. At this point you need to make a decision whether you want to pursue canadian GC or US GC. If you have applied for 485 then it best that you not do the canadian landing. You may have issues when you come back to US. They may ask you why you went to canada and you cannot lie and have to tell them the truth. This may raise questions on your intent to pursue US GC. It all depends on your luck as to who you get the IO. I have heard of a case where a person got RFE on 485 after completing the landing.
If you still want to do the landing then you should be prepared for RFE or NOID on your 485.
Thanks dingudi. If you know of a solid case where someone was RFE'd because of landing while on 485, then it looks like I might seriously consider abandoning it as well.
One last question: Let's hypothetically say that I do decide to land and somehow manage to get back into the US without any issues using my AP. However, every subsequent time I leave the U.S. and return, I run the risk of getting "caught" at the POE with regards to the 485/Canadian residency conflict. Am I correct in this assessment?

I have a question reg. the unfair vertical spill devised by USCIS when allocating the visa numbers after the initial allocation is completed.
If the country needs EB1 categories first then the EB2 categories and then EB3 then why did they allocate equal numbers to all the three categories initially. If they needed more EB1 or EB 2 compared to EB 3 numbers they should have given 3x of numbers to EB1, 2x of numbers to EB2, and only 1x or less than that to EB3 when doing the initial allocation itself.
Its only due to some genius person's invention that USCIS decided to implement vertical spill over instead of doing a hoirzontal spill over of the numbers which will be fair.
Now the EB2 folks are going to comeback and say that EB2 deserve more rights and all that blah blah aka the fight people give whenever somebody tries to remove the unfair quota system in India. Grow up and behave like an educated person.
You can say that EB2 folks earn more... give me a break I know many EB3 folks who earn atleast 2 times more than whan an average EB2 guy earns. Its just a matter of luck(in the current scenario) that a person got applied in EB2 or EB3 category

I am a lurker in this site. This is my first post. I have seen many posts by United Nations. He has helped and still trying to help many users at IV. His posts has insight and valuable information. Doubting his intentions just because he is in this society for 35 years is not appropriate.
I agree, UN has given good, free advice and information worth thousands of dollars in here without any malice, and he's always ready to give any info, i think he deserves more respect that someone childishly questioning him.

Like poste din another thread, I called USCIS customer service today to speak about EAD application that has been pending for 60+ days. The Phone rep told that he cannot give me any information about any cases right now since their "system is down". I asked for clarificationand he said that cases are still being processed but the system used to view status is down. Not sure what that means.
Not sure if this will cause any more delays .............. I need EAD renewed by Sept since my current one expires then
Also anybody has any ideas on what "Plan B" might be if renewal is further delayed by sept?
