Just dont get what the senator is intending here ....
"The business model of these newer companies is not to make any new products or technologies like Microsoft or Apple does. Instead, their business model is to bring foreign tech workers into the United States who are willing to accept less pay than their American counterparts, place these workers into other companies in exchange for a consulting fee, and transfer these workers from company to company in order to maximize profits from placement fees. In other words, these companies are petitioning for foreign workers simply to then turn around and provide these same workers to other companies who need cheap labor for various short term projects."
Does this mean every H1b at MS, Apple invents ipod, iphone, USB etc.... and there is no similarity in the nature of work done by him compared to that coming from a consulting company at a client site..... he talks about products or technologies but what about services/speciality occupation using these products/technologies ... that is exactly what most of the IT sector does....
"The H-1B is a non-immigrant visa in the United States under the Immigration and Nationality Act, section 101(a)(15)(H). It allows U.S. employers to temporarily employ foreign workers in specialty occupations."
Not sure if senator is missing it or dodging it ....

Came here in july 1997
filed LC in 2003 thinking it would be useful to stay on H1 as long as possible!! and the rest is on my profile..
I wonder if anybody thinks it makes sense to create a law which simply says after 15 (or some X years) of legal presence in the US you will be given a GC no matter the back ground! In that way we know exactly where the deadline is irrespective of some government agency's whim.

EB2 requires Masters or 5 years of experience. For those waiting in the queue for more than 5 years should automatically qualify for EB2 because they have 5 years of experience. I dont care the fine wording that says the job needs Masters or 5 years of experience. We should push lawmakers for this option to reduce the huge backlog. What do others think of this option and start a campaign for it?

Not that I say we need change, but this is a public organization. Everyone has a right to call for election. There is nothing wrong.
Only issue is, whoever wants to contest has to come out with public profile as mentioned by someone before. There are only few people who are openly public and with known real identity on this forum - thats sad!
I am surprised to see that IV has 450K asset! Where did that number come from?
Ever been a member of a public radio station? to vote or contest in an election you have to be a paid member. Do you think N**usa will entertain you if you go to their website and call for change?

I am sure you'll get GC by the end on this year or early next year. I might have called USCIS abt 15-20 times and from what I understand dates would retrogress for eb3 India, but not horribly. My guess in of the total applications in August 30% have older PD 02/03/04. Becuause pf PERM processing majority are 05/06/07.
thanks for ur input and still sticking to IV ..

Please read the purpose of the organization.
Information exchange is only a by product and not the goal of IV.
With this model can IV still claim to be a non-profit organization? It seems you are exchanging information in return of cold hard cash? :p

I'm really hoping they'll catch up and we won't have to wait 4 months. My 6th year H1 is expiring this December and I need to get the I-140 approved so I can get H1 extension.
You dont need a approved 140 for filing H1 extension for 7th year.. Only advantage with approved 140 is you will get 3 yr extension instead of 1.
All you need for H1 extension for 7th year is that a labor cert be filed at starting of 6th year.

I think I have been very lucky so far. I don't think USCIS processes based on anything concrete, I think it's a little random. Or maybe I am just lucky.
I applied for PERM in Sep 2006 - EB3 - India.
I got approved for PERM in Mar 2007.
I applied for I-140 and I-485 concurrently in Jun 2007.
I-140 got approved July 20, 2007 and on July 23, 2007 I received all 4 receipts for I-140, I-485, EAD and AP. So my approval came before my receipt. I live in California so everything went to Nebraksa.
Lawyers emailed saying they also received the EAD card yesterday July 23, 2007.
Now I have to wait for only AP and Adjustment. And I still have 5 years left on my H1-B (2 years on this visa and then another extension).
So I say, anything is possible. I wake up every morning and pray to USCIS because they made my life better :) :) :)
Something is wrong it is impossible.... wait a minute your name is luckypaji....may be you are sardarji...just kidding brother dont get mad.

dear members,
please post ideas on how we can all collectively address such issues. We have to spread awareness, get attention from law makers, remove the fear instilled into minds of people, guide people in the right direction.
Ideas and suggestions are welcome.
I would say we should start with local congressional office. Every case whether it is resolved or not should be taken to the attention of local congressional office.
If members volunteer to do this, we could distribute districts among ourselves and take care of each district's congressional office. In that way we could raise the awareness among the lawmakers. I do agree that not every office will be friendly to immigrants like my district's congressional office, but we have to try.

I never knew all these so called multinational executives work for noble cause...hilarious
Time and again you are in attacking mode. You need to learn some concepts better, including english comprehension. Don't worry, everything will happen with time -- after settling in USA your kids might help you learn

Let is choose one, otherwise we run the risk of diluting the whole idea, I have put up a poll.
I am Ok with this idea as long as the issue doesn't get diluted.
I think everyone should send the letter in the same format though.

In 2002 all the EB visas were issued (174,968). However, there were 31,532 unused family preference visas, so the limit for 2003 was 171,532 (140,000 + 31,532).
Guess what, in 2003 they only approved 82,137 EB visas, so they ended up with 88,482 unused EB visas
From where did you get 174,968?
Is there any case where unused FP #'s were captured for EB?

You don't need to be harsh on your comments. You can go ahead and file a case with USCIS. That's what I've been saying here all the time.
Calling me a numbskull I think is inappropriate. You can disagree with me and I can disagree with you which is the essence of this forum but not to abuse each other.
I didn't call you numbskull and I will never call anyone numbskull, so I guess you owe me an apology.
That is right. People can express their opinions. No name calling and rough language.

That is a wonderful proposal and should be given due weight. Despite the early arrival, an individual may not filed his/her GC due to several reasons. Most commonly found / heard are
1. Company closures/ Layoffs / Transfer to different state
2. Employer / attorney delay and / or fraud in filing GC
3. Delays in processing Labor in certain states / backlog centers
This proposal seems a ray of hope for people in the above category. God bless Rajeev74 and all. Let this be heard and got attention at the policy level.

Lacris, I went to SSA office to get SSN rejection letter for my wife as she is on h4 (DMV needs rejection letter to renew the license) and SSA Agent checked the passport of my wife for the expiry date, May be they are checking the expiry date now a days, I think you need to renew the passport and go to SSA office for SSN, But I may be wrong
Reddy77, I understand that in your wife's case the person at SSA needed to see something to show your wife's immigration status (I took a letter like that for myself 3 years ago). But in my case, my passport doesn't say anything to her other than the fact that I have an H4 visa stamped in. The moment I got the GC, that visa is not valid anymore, so it shouldn't make any difference. But thank you for taking the time to answer.
Thanks mariusp, but she asked for the passport, didn't want to look at DL.In her defense, I checked the website and the original text of their Regulations and it doesn't have Permanent Resident card listed as an immigration document, but EAD is there.:D . I'll try again next week.
